The Local Reporter: Will Carrboro’s Duke Energy Lawsuit Make It To Trial?

CARRBORO – It’s been almost a year since Carrboro sued Duke Energy for its alleged role in local climate change, and the case has yet to go to trial.

The case may never get that far. Duke Energy has filed a motion to dismiss Carrboro’s lawsuit and Judge Mark Davis has requested legal briefs from both sides before deciding on the motion. The deadline for filing briefs was this week; the decision is yet to come.

Fresh legal ground

Carrboro has been working for years to become more environmentally friendly and reduce the town’s contribution to climate change. As part of that effort, the Carrboro Town Council voted last December to sue Duke Energy, arguing that the utility has contributed to worsening climate change.
